two deposits for the Speciale

Hi Folks--

I have a deposit down both in Albuquerque, NM and El Paso, TX for the Speciale. The deal is standard dealer pricing with free first service. I only need one, and don't want to lose the deposit on whichever bike comes in second. If anyone would like to purchase the second one instead of me by taking over the deal, send me a message!

I hate waiting! I've bough two bikes each from both dealers, so I know them well. El Paso is closer, but I might be able to get the bike from ABQ sooner. I figured for a new bike with limited quantities I might get one faster if I tried two dealers.

thats kinda of funny....but ok, you did it....since you have a history with both shops...couldn't you just ask one to cancel now ?

Yes, I can. But how do I know which one is going to get the bike first? They don't know, so I can't either. When I got a SuperSport S the time difference was months.

Deposits on vehicles are refundable in the US.
When you get the bike from which ever dealer gets it first cancel the other and get your deposit back.

This is true !!! You may cancel and retain you full deposit.

It's not like the Speciale is a custom allocation ;-).

With that said, I don't blame ya

Interesting... A third dealer in AZ told me if I ordered from the, the deposit would be refundable only to the point at which the bike shipped from Italy. Not true?

Not true, but there is some technicality to this and also depends on how you handled the situation. If you gave a non bidding deposit for a bike that was not physically in stock when the transaction was done then you will get your deposit refunded. Your deposit in this case just means you have first dibs to purchase a bike thats was not even available at the time when its makes its way into the dealership, but you also have the right of refusal as well.

Now if you signed a document stating you agree to giving them a non refundable deposit, signed a actual sales contract or you had requested the manufacturer modify the vehicle outside of its normal production spec specifically for you (if thats even possible in this case which i doubt) then you would be on the hook for the deposit.

I believe the preorder for the SL required you agree to purchase the bike and sign the sales contract at the time of the deposit or the deal was off. In that case you pretty much own the bike and legally bound to follow through with the purchase. I ordered a v4s so im not sure if this was a speciale requirement but i dont believe it was.

I dont know what you initially agreed to with these dealers but typically deposits are refundable especially on pre orders, and if they never told you the deposit is nonrefundable when you put it down it should be refundable.
I would read through any paperwork you may have signed.
