A little advice needed: Operation- "taking my bike back from the dealer"

Tomorrow I'm going to attempt to regain possession of my bike after it was held against it's will by the dealer for the recall suspension bolt that, apparently, was not indicated since my VIN is in the 2000 range and not the indicated 4*** region as previously discussed.

Tactics question: I want to proceed in as delicate a manner as possible... If the bike is still apart or has not even been disassembled; I am going to ask them to allow me to roll it out and put the bolt back in: What should I do if they balk?

If I'm allowed to replace the bolt: which tools (hex drive size and length extension) should I bring? (their service dept is closed on Monday's, thus the tools) I'm also going to bring my paddock stand, floor jack stands and a light weight jack to assist my re-assembly.

Can anyone on the forum please check that Hex size for me on their bike?

If they resist; are small arms (AR-15 or .45) indicated? ;)

I expect that Gunny will have some mods to add to this operation.
 
The correct bolt has an 8mm allen head. You'll need an extension unless you can remove the rear fender. I don't know what the recall bolt allen head size is so bring a couple of different sizes. However, If the dealer doesn't have the correct bolt as they said, then I don't know why they would disassemble the bike? It's not like is easily movable.

As for everything else..... dunno, but good luck.

I just told my wife about your last comment and we are sitting here laughing! Thanks Bro, I appreciate the confidence and also got a kick outta the "small arms" comment too!

Seriously though, I don't know what to tell ya brother. When it comes down to it I am quite sure they will pull the liability card. I agree that being as tactful and "killing them with kindness" should be your first attempt and hopefully will pull it all off for ya. When, and if, it doesn't work I don't want you going to blows with them and burning your bridges (all these funny euphemisms) I wish I had an answer for you on this. If you need back up I advise you to call in ...... over at NY Motorcycle (again unsure where they are now-but you told me once) and ask him for help. You can PM me for all my info so he will know exactly who you are talking about when you use my name, etc. You know we will all be waiting to hear what went down my man, so let us know asap if ya can!

If your dealer of choice, and a good dealer I would want the relationship to continue. I would ask nicely why the recall if it wasn't applicable, that is to say on the list of recalled bikes. I cannot imagine a dealer taking on a recall that wasn't required as the paperwork wouldn't jibe, in that the VIN presented to Ducati would not be within the list of VINS requiring the recall. I would imagine Ducati refusing to cover the costs since the recall wasn't required.
 
I'm not really sure why they'd NOT let you take YOUR bike. I thnk explain the situation, and if they play the liability card tell them you'll sign a release. But bottom line, it's your bike, unless you owe a repair they can't legally keep it. This shouldn't even be an issue, they should just say, sure, we'll help you load it.
 
Que the "mission impossible" theme music...

3 hours until deployment....gonna fast-line down onto the dealer roof, blaze a hole through the sky-light, use my suspension rig to drop in behind the front counter, chloroform the parts rep and gag/zip tie him, commando crawl to the stairs leading to the service department, next level down, drop two flash bangs and a smoke screen. THen round up any civi's and secure them to their work benches and then I'll re-assemble my bike and leave a 50 foot patch of rubber as I do a 10 grand clutch bomb to crash through the bay doors and get my bike back!! Hopefully, there will be no need for wet work.

OR...., I'll walk in and say, good morning gentlemen; I'd like to pick up my bike, if that's all right?

I will have already secured your perimeter with claymores and taken out the roving patrols with a million pound compound bow. I am now bunkered down with a suppressed Barrett 50 cal and covered in my ghillie suit. I have your six covered so advise me when you are feet dry brother!

Tell them you're taking your bike. If they resist, citing liability, tell them you have decided to take it to another Ducati authorized service agent. If they continue to resist, tell them you are calling the police as they have no right to hold your property and that you are calling Ducati North America to complain about them trying to force you to use them for authorized service by holding your bike hostage.

You have a right to your property and you have a right to get your bike serviced wherever you choose. They have no right to hold your property to force you to use them as an authorized service agent, liability or not.

but i get the impression you dont want any confrontation you just want your bike back.

I think your right - walk in " im here to pick my bike up "
be prepared to ride it or trailer it
once you have stated you "want it" i would not leave without it.
if they refuse, im sure your within your right to call the police to assist
