You could sue the guy, but for less than $3K its not likely worth your time or additional expense. At this point, it sounds like you have what you have. At least you know who not to deal with in the future.
All the misery for a damper bracket, it's a $60 part. If you order one from Woodcraft, make sure it has the inserts so it fits on the thinner part of the Ohlins forks so you can get it all lined up right.
