Ebay seller alert

Just to watch out for a Ebay Seller from CA called Crestwar, I bought a lower rad and when it was delivered the inlet was damaged, not shown on ebay pictures, I didn't make a big deal but I dont want a damaged rad and asked him to sent me a returns label, he asked me to pay returns which I will not and since then he has tried to drop the price by $20 then when I dont want that, then started to blame us for the damage and still we wait for a returns label, this morning I contacted ebay to escalate the the issue to try and get my money back. They say be Wednesday if he hasn't sent the label then they will pay me back the money and they will send a returns label, but its the hassle factor, like I have nothing better to do than .... around with these losers!
These people who try and rip us off and then try and weasel their way out should be banned from sites like ebay!
 
Update on this, ebay said they would pay me back but now trying to contact them is getting to be near impossible, the rad is still sitting the Crestwar who sold it to me is insisting I pay to send back the damaged radiator which I am not going to because he got 140usd of my money and I dont want to lose more. Its a scam because all he needs to do is send in a courier, he is trying to keep my money and not have back the damaged radiator. I made the mistake buying from Ebay a used radiator that I accept, I was under the impression that Ebay protects us from rouge sellers, I am not so sure now!
 
feb 20th just constant emails to and fro with ebay telling me they are keeping my money on hold, I just ridicule them and swear at them for trying to force me to keep damaged goods and knowingly allowing con men to operate off of their site, they also tell me that I need to co operate with the seller, that stopped when Crestwar turned out to be a con man and their idea of cooperating is that I pay return postage for damaged goods.
 
I bought from Crestwar few times in the past got a few speedo cables never had a issue. His feedback has a few negatives but nothing more then your average Ebay shop.
 
I thought with the rating I wouldn't have an issue, and I didn't mind that its damaged, .... happens but I dont want it, I dont want to pay for it to go back and want my money back thats all, he made such a big deal rather than just send a courier to take it back. Fact is its still sitting there and I dont know why they just dont send me by email a return sticker or send a courier, I guess he wants me to keep it! you can deal with this guy but this my story. Meantime because ebay have no idea what to do I have been to the bank and I can put a claim in through Mastercard to get the money back.
I stopped buy electrical stuff from ebay a long time ago and I now stop with used bike parts, its not worth the risk, its not a lot of money but its the principal.
