Rear brake locked

Alright, so about 1000 miles ago I installed some rizoma rearsets on my 1199, yesterday while I was riding around on the street I notice the bike dragging the rear while in neutral, eventually in stopped the bike, rear brake locked up, so I unscrew the push rod and ride it home. I figure it didint have enough free play so I give it some more. Ride it for another while, check on the pedal and free play and its gone. I give it some more space, allot, and drained some of the brake fluid to relieve some pressure. Rode it for about an hour today, and low and behold, pedal is tight again. The rear hasn't locked up completely again, but I fear it will being the damn push rod cant keep its free play.

I'm prolly going to take it to the dealer soon, but any ideas?
Rotor warped maybe? I just dont understand why when it cools off it doesnt relieve the pressure on the push rod.
Oh, and no I'm not resting my foot on the brake pedal, I dont really use it much in the first place.

The rotor is easy to check if you have a paddock stand, which I am guessing you don't. If not, have someone roll it. Either way, watch the pads touching the rotor and you can see if it gets closer/further away as it turns. But definetly get it to a dealer. I would think roadside assistance coul e used hear. Don't mess with riding a bike with bad brakes, deadly consequences.
 
Check the brake pedal stop. If the locknut is loose the screw will decrease play all the way to locking the wheel
