BMW s1000rr ABS at its finest

I just watched it several times starting and stopping it very quickly on and off from the 9 second mark until the flip. The guy does not appear in any "frame" until he starts running to the left of the bike. What else is odd is that even in freeze frame, the picture is perfectly clear until the about 1/2 second before the guy appears until you seem him running away. During about a second the video is all blurred out then it gets clear again. I'm not sure there isn't some sort of photo shopping the video - very strange.

I just played it in adobe premier frame by frame and I can see the A-Hole running across before the car hits his brakes and jumps out in front of the S1000RR. His clothing makes it difficult to see. I noticed he also had a buddy jumped out with him but went back to the curb.
 
ABS worked perfectly. If it didn't, he'd have low sided grabbing that much front brake. Doesn't excuse the fact the rider was either overestimating his skills. Or underestimated the s1k's braking ability. And he didn't RTFM.

Rear lift detection is disabled in Race & Slick mode. BMW even warns pretty explicitly that in Race & Slick it's possible to loop the bike forward. Those modes are fine for the track since nobody is braking to STOP RIGHT NOW on a track. So this guy was in one of those modes.

I rode the street in Race mode till I had the back end keep climbing and climbing and climbing...
 
I think the pedestrian was standing in the middle. The question is, is it legal to ride on that lane?
