Not much sympathy for someone who shows up *late* for a court date without a lawyer facing a charge involving potential jail time and then proceeds to give a judge some attitude.

And you wonder why things aren't going your way?

Your best route is to prove your alibi; that is, you were at work or somewhere else at the time of the alleged incident.
This happened to my father years ago, in Montreal. He got a notice of a fine for a parking ticket that was not paid (over due). My dad was suspect, and so he cross-referenced where he was on the day of the alleged incident and discovered he was in Toronto (5 hours away) for work. It turns out, the cop had likely collected plate numbers of vehicles he had seen on previous patrols, and then later issued false tickets for those vehicles which of course, were never placed on the vehicle. The court chalked it up to a mistake by the officer (as opposed to fraud) and the ticket was thrown out.
If you can prove that you were elsewhere at the time; you are home free (except for all of the time away from work and all the other crap).

Your best route is to hire a lawyer and let him handle it. Period. Don't concoct an alibi. Don't give anyone attitude. Don't do anything related to courts, cops, or prosecutors. Sign an appearance waiver and let the lawyer handle it.

I got a sheaf of four tickets in October, all but one dreamed up by an overzealous Sheriff's Deputy employed by a department that wants to keep motorcyclists away from the area where I was riding. The lawyer not only got the three pipe-dream tickets dismissed, but the legitimate one, too. I never went to court once, and that alone made the $350 fee justifiable. No court costs. No fees. No fines.

On a separate note, I'm still raving about the fact that this Deputy was willing to compromise himself and his ability to ever appear in court as a witness by swearing out false tickets. What a short sighted way to discourage an undesirable element. One Go Pro mounted on the bike and.........
 
I had a similar issue many years ago - my lawyer asked if the cop knew the color of my car to prove he had actually seen it - he guessed wrong, case thrown out.

Charlie is right - I get pulled over, I am an angel so it makes it easier for my lawyer to get me off. In St Louis, it is easy - they just want your money - they always reduce it to non-moving.
 
I am surprised that nobody else asked how if your license plate was obstructed they can prove that it was you and your bike.
 
Obstructed can mean different thing legally, to include partial obstructions or tinted covers etc. Hell, depending on how the law is written having it folded up or excessively dirty.

Everyone seems to always be lost on that what a law or wording/definitions written into a law can vary wildly across jurisdictions.

Showing up to court w/o a lawyer is like going to a union job site and trying to build a wall without knowing anything about construction except what you read on Google. You're going to look amateur and f*cked up, if not just disrespectful of the process and the experience of those who actually work in that system from day-to-day...ie the judge.

Exactly, court Is not a place to be when your 100% ignorant to THEIR language and terms.



In this case his Lic plate was probably identified by a LEO, now he has a right to offer up who he let ride his bike that did commit the said crimes, or take the rap as the registered owner.


Outrun a cop here in Ca, and if they get your plate number, they are out to arrest you in the morning at home or at work for a felony.


Sounds like OP is getting hammered up the tailpipe soon enough, if he doesn't lawyer up now. And he will still, more then likely be found guilty because he was.
 
I have yet to get a ticket since I started to ride SB's again and not for the lack of trying.
What saved my bacon was being non emotional, respectful and most of all thinking like a cop.
I would let them know where my license, proof of insurance and registration are located before I reach for them while pointing out that there is nothing in these places that could be used as a weapon.
The radar detector earned its keep as well. ;-)

How about you pay my bills you degenerate.? That sound good. Because this scumbag cop and scumbag judge surely wont be....

The point here is this is how the system works. The law doesnt have to prove a god damn thing yet they can force you to miss 4, 5, possible 6 or more days of work for a trumped up ticket by a vindictive (for what reason I do not know) cop.

Next try.
 
There was no running nor any allegation of fleeing from police. There was no criminal offense of fleeing charged.

Absolutely. Ive got a family full of LEO's, ive interned, done years of school in the field, had many friends on the job so plain and only once was cited a moving violation by some young one my age fresh out of the academy trying to make a name for himself. Ive been lucky and told to "get out of here" numerous times. Ive had more serious issues be handled in one or two days in court. Now this judge has the gall to tell me i have to miss a 5th day of work.

Back when I had just gotten my Primer 1199 I got stopped for 10 over on a main thoroughfare in the town I grew up. Officer said he wanted to make contact with me simply to be careful which I have been on public roads.

All you pro-cop, pro-court system clowns would be singing a totally different story if you were me so why don't you lighten up just a touch ok. Ive done nothing wrong here, i'm not the criminal. The only thing being violated here are my rights and my rights alone. This is the new America folks. The police don't have to prove your guilt. You have to prove your innocence. Its been becoming this way more and more every year.

At the end of the day this just makes me want to give up street riding (and having a registered street bike) in its entirety. Keep myself faster and safer on the track :)

I realize obstructed means many things. What I don't get is that to read an "obstructed" plate the cop had to be close to the bike. Why didn't he pull him over? Honestly, this is the first time I have ever heard of a ticket showing up in the mail other than the camera tickets. I guess I live a sheltered life.

To the OP, you have admitted you have had many bad encounters with the law, and that you made nasty remarks to the judge more than once. You might want to be a little more insightful as to what you have done to contribute to your own problems.

New?? What kind of proof do you require from the police? They see you break a traffic law, that IS the proof. They have never been required to bring witnesses to court for minor traffic violations, and shouldn't have to. And how in the world do you miss an entire day of work for a court appearance is beyond me. If you don't get paid for not showing up, then you would have been way ahead hiring a lawyer. Simply obey the law and you won't have to go to court. Don't, and you risk dealing with the "process", which a lot of us have, big deal.
