unknown.. I bet differed sentences because of his age.. community service and some sort of settlement... he would likely lose his DL for a set number of years if not for good..

To me the double line is just a suggestion . If it's safe to pass I'm going to do it different story when I'm driving a car .
That guy needs to be skull ...... for pulling that move .

/thread

I pass on double yellow all the time when it's safe, but I usually give people a wave don't do it in an overly aggressive manner. Most people where I ride will pull to the side for me, if anything that seems to happen more since I picked up the 1299

But what's the minimum sentencing
Max is rarely enforced

So very very true. Listing maximums is great for headlines.

Sec. 12.33. SECOND DEGREE FELONY PUNISHMENT. (a) An individual adjudged guilty of a felony of the second degree shall be punished by imprisonment in the Texas Department of Criminal Justice for any term of not more than 20 years or less than 2 years.
(b) In addition to imprisonment, an individual adjudged guilty of a felony of the second degree may be punished by a fine not to exceed $10,000.

Double yellow means no passing...I dont.

Unfortunately that old .....'s mentality is becoming far too common in our society.

Why does riding a motorbike suddenly give your life no meaning.
I don't understand the horrific entitlement drivers have now a days. You wouldn't have the balls or be as bold to try and take my life if you were standing in front of me but suddenly because youre in a car that all changes? I don't understand drivers and road rage. Especially soccer mums.
Its somebodies life youre trying to take.

The law needs to do something about it and road rage should be attempted murder! Is it no exactly that? Trying to take someones life.

Twisted Rabbit
you should form a protest group and appear at a his arraignment / trial
make sure he knows how mad everyone is

I don't know how it is texas...but in PA, you can basically do a lot of things as long as there are no posted signs saying you can't...

like turn on red... You can turn on red at any intersection...as long as there's not a sign saying "no turn on red"

My brother in law is a cop/detective of maybe 10 yrs...and he told me that there is actually no law saying you can't cross the double yellow lines...
the texas police can write him on any vague law they want...but it's probably not specifically for "crossing the yellow lines" because it's not illegal (at least not here, and possibly not there either)

United States[edit]

A double yellow center line in the United States indicates that passing is prohibited
A double yellow line is a painted marking between opposing sides of a highway. It consists of two parallel, solid yellow lines located between the two directions of traffic flow and its presence usually indicates a no-passing restriction or no passing zone. Obvious exceptions to this no-passing restriction include emergency maneuvers or temporary traffic flow changes due to road work. Often the double yellow line has sections where one of the lines becomes dashed (in which case it is no longer a "double yellow"), indicating to the drivers traveling on the side closest to the dashed line that they may pass when it's safe.

Two municipalities in the state of Rhode Island, Bristol and Warwick, replace the double yellow line with red, white, and blue striping along certain routes.

In some states, it is not against the law to overtake vehicles in the presence of solid yellow lines if it is safe to do so. For example, Vermont State Law also allows passing across the double yellow line when no traffic is on the opposing side, however, one must pass quickly and return to the proper side. [10] Pennsylvania also permits passing on double yellow lines when not also posted with "Do Not Pass" signage. [11][12] However, this is unusual as most states have a ban on crossing a double yellow line except when turning, when passing pedestrians or bicycles, or if an obstruction in the road makes it necessary. Overtaking another vehicle across a solid yellow line is usually considered a serious traffic violation in most states. [13]

hmm maybe it is bad in texas.... but eitherway what he did was that's attempted murder.

oops forgot you live in ohio my bad
if i lived in TX (right) i probally would organize a large group and make sure he knows how many people are upset.

In Texas...

Texas Constitution and Statutes - Home

Sec. 545.001. DEFINITIONS. In this chapter:
(1) "Pass" or "passing" used in reference to a vehicle means to overtake and proceed past another vehicle moving in the same direction as the passing vehicle or to attempt that maneuver.

Sec. 545.055. PASSING TO THE LEFT: PASSING ZONES. (a) An operator shall obey the directions of a sign or marking in Subsection (c) or (d) if the sign or marking is in place and clearly visible to an ordinarily observant person.
(b) An operator may not drive on the left side of the roadway in a no-passing zone or on the left side of any pavement striping designed to mark a no-passing zone. This subsection does not prohibit a driver from crossing pavement striping, or the center line in a no-passing zone marked by signs only, to make a left turn into or out of an alley or private road or driveway.
(c) The Texas Transportation Commission, on a state highway under the jurisdiction of the commission, may:
(1) determine those portions of the highway where passing or driving to the left of the roadway would be especially hazardous; and
(2) show the beginning and end of each no-passing zone by appropriate signs or markings on the roadway.
(d) A local authority, on a highway under the jurisdiction of the local authority, may:
(1) determine those portions of the highway where passing or driving to the left of the roadway would be especially hazardous; and
(2) show the beginning and end of each no-passing zone by appropriate signs or markings on the roadway.

Acts 1995, 74th Leg., ch. 165, Sec. 1, eff. Sept. 1, 1995.

No matter what, smacking someone with your car isn't justified because they wrongfully attempted to pass you.

William Crum sends Granbury motorcyclists to the ditch, not his first encounter with law enforcement - News - The Glen Rose Reporter - Glen Rose, TX

QUOTE FROM ARTICLE
However, this is not the first time Crum has had a run in with the law in Hood County, or Somervell County for that matter, and is also not the first time he has been accused of misconduct with a motor vehicle, according to arrest and court records.

On July 28, 1989, Crum was arrested by Arlington police for assault and family violence, and later charged and sentenced to one-year's probation. He was also force to pay an undisclosed restitution. Fast forward a few years to Aug. 23, 1993, Crum was picked up by Granbury PD for silent or abusive calls to a 9-1-1 service - a class B misdemeanor that was later dismissed after he recognized himself as the culprit prior to the case being deferred on Sept. 9, 1993.

All illegal, but not exactly relatable to the current charge.

Six months and change later, Crum was scooped up by Somervell County sheriff's deputies for unauthorized use of a motor vehicle - a 3rd degree felony he plead no contest to. Crum was convicted of the charge on Sept. 26, 1994, which resulted in an $87 court cost, 80 hours of community service and two years of community supervision.

Thirteen years later, he was again found to be improperly using a vehicle by the Somervell County Sheriff's Department. Crum was observed to be driving recklessly on March 28, 2007, but this time was also charged with making a terroristic threat. Despite pleading 'not guilty' to the charge of making a terroristic threat, he was later convicted of both charges and confined to two years in jail, while being forced to pay $500 in court fines and a $612 court fines.

This article is haunting me. I was riding yesterday and on a long straightaway had two cars in front of me and tons of room to pass, and look down and its a double yellow. I swear I thought that it was a test from a higher power. This damm article going thru my head"¦I even said out loud, in my helmet, to myself "Ohhhh .... no"...I slowed down and made a big gap and looked around and enjoyed the scenery for a while till the road opened up and we hit the Interstate. I figured it was a test from God for me.

If its your time its your time Bro. No use jumping for shadows. Ask me. I run around in places like Iraq doing high risk security. I have seen guys get heart attacks there because they worry too much. Have fun, but try not to injure/endanger others while doing so. :D

Deputies booked Crum into the Hood County Jail just after midnight on Tuesday, saying that he was uncooperative then and remained so later on Tuesday. His bond was set at $75,000 for each charge.
Before being arrested, Crum explained that the swerving was his reaction to a spider bite. However, he was captured on video saying "I don't care" about the motorcycle crash and the two victims. "On that particular road," Crum said, "I've seen them do wheelies at 60 mph, and I thought he was one of them. I didn't know there was a passenger."
If he is convicted, Crum could face 20 years in prison for each count. "He's getting locked up," said Sanders. "The state is filing charges on him, straight up."

Crum also a month earlier near this same stretch of road also tried
twice before to run two other bikers, another with a passenger off
the road and was charged in one of those actions with reckless
endangerment with a motor vehicle and is still facing those charges.

Debra Simpson is now in a regular hospital room and has undergone
4 different surgeries and a few skin grafts and still has no certain date to be released. She remembers very little about the accident other than closing her eyes.

South Africa is even more dangerous. Here all the houses toilets have bullet proof doors and the women folk leave the country a day before Valentines.
