A class action doesn't mean you will lose money out of your own pocket, maybe you are not understanding how a class action suit goes. Someone, hell, BMW could put it out there that Ducati misrepresented their numbers to sell over their S1000RR (they claimed more HP than BMW then). They contact ducati owners who may have been effected (all) and put a huge court ordered fee out on Ducati. This could be to just shut ducati down so one less competition. These class action suits happen all the time in the USA. Maybe you missed when airborne medicine was sued because they werent really a medicine they advertised to be.... That was 23.3 Million to be settled. And that was just a normal guy who took them to suit and got them to admit their wrong.
