If you choose to leave the surface of the pavement then whatever happens after that is your own fault.

This was also discussed in Facebook group and someone said that "runoff" areas should be clear because instructors routinely tell riders to run off the track if they think they are going to crash. I nearly lost it when I read that. I've been doing trackdays for about 10 years now and I've never heard that. Instructors always advocate the opposite.

He looked like total noob in the video wasn't even close enough to run wide to try overtake.

The sand bags to me and their placement make zero sense though.....

On our track here in wa they have banned m/c at barbagello raceway the only main track built in 69. No FIM spec track for us or something decent.

One guy hit the sand but they didn't bother to rake the sand flat so when he came off hit a high point in dirt twisted his back now a quadriplegic.

This was during championship not a clubday either.

The walls are too close to the track, few riders have died.

The place should have been shutdown a long time ago its a .........
Third world developing countries have better tracks.

I've ridden Laguna several times, both when Lance Keigwin and now with Szymon. Both are excellent and ran very fun and smooth track days.

You can't really do much in that turn anyways because the sound booth is right there where Kim crashed. Maybe he tried to pass, realized the sound booth, adjusted for that but didn't continue to commit his line.

I did a sound check with my 1199 S with a stock exhaust and it barely met the sound requirement of 92db. During the rider's meeting they address the sound booth and 3 ways to get past it:

1)Short short shift after T5
2)Roll off the throttle after T5
3)Keep your gear and stay towards the left hand section of the track

They also have db rule.
1)Aftermarket exhaust wout silencers-1 black flag and you'r done for the day
2)Aftermarket exhaust w/silencers-2 black flags and then you're done
3)Stock exhaust-3 black flags and you're done

However, I do understand the danger of having those sandbags there. It's groomed during a regular race so why wouldn't it be groomed for track day events.

Those who have rode Willow Springs also know that Turn 8 through T9 is not only the fastest part of the track but has an extremely horrible run off area. You do not want to wash out there doing 150 mph because once you're off the pavement it's filled ruts from soil erosion and you'll go tumbling like a rag doll.

I remember going up to Dustin Coyner of TrackDaz back when WSMC was still club racing there and telling him about how ...... that T8 run off is. He brought it up to Bill Huth's attention but has never been fixed in the 14 yrs I've ridden Willow Springs.

Guy should have had another hobby. Obviously not a competent rider by any stretch of the imagination. Keep your day job and get lost. Reminds of the lawsuit at Fontana with FOC San Diego and the Carrera GT. Look it up. Two fatalities. They sued FOC, Penske, Porsche etc....

If he wins, I won't be the least bit surprised if a group of anonymous trackday junkies break his other leg
 
He could have made that turn, and should have. He butt puckered and went wide, had he kept on the gas and leaned over, no problems. Looks like he let up on the throttle, the suspension unloaded, and he went wide.....My very first MSF instructor from 30 years ago told that very thing. It saved me before and the things too.

Totally agree, if he looks where he wants to go (track). He could easily make that turn he got so much track to work with.
Not totally agree with what he is suing but agree that sand bags shouldn't be there
 
the trial is not until late may, the way things are these days...so everyone with comments in this thread can look for their deposition subpoena since it's ducati-related and we have a lot of track experts here. i've only been on the track twice so i know nothing, don't contact me.

i'm kidding.
 
If I was in a jury, given what I see here...I would cap the settlement at some number lower than the asked damages. It’s pretty clear he crashed due to rider error. It happened after he had already done a few sessions and knew the sand bags were there....

Exactly why he should get no compensation. If you don't know your own abilities you have no place on a racetrack.

Didnt attend rider briefing , go home. Legalities stop there. ........ did everything wrong , couldnt trail brake to stay wide , so cut in early, couldnt achieve any apopriate lean angle for his speed, then target fixated well before the ripple strip and came off . Suck it up! Adrenaline rush comes at a price, dont expect everyone else to compensate for a ......... inabilities. It may be argued he is not a noob, but any accomplished rider that is coming in to hot usually crashes washing off the speed.
 
i look at it slightly differently,

as i work within the HSE and technical incident investigation field,

if you forget the fact that he ran off the circuit ( talent etc) its the fact that the organisation left something in the run off area that worsened the result of running off the track.
the fact that they remove the sand bags for international or professional racing, shows that they recognized an element of risk, but failed to manage the risk.

forget who he is and the numbers, if this happened to me on a circuit in Europe i would also be getting legal advice for sure, they have a duty of care and failed to mange that duty.

It's ....... sad how sosciaty became lawsuits addicted.thats the same type people who getting in fender bender on street and thy first thing thy ask for ambulance and neck brace.i can guarantee this is not his first time.that's why we paying high insurance premiums and track days going to cost more and more.its all ready happening.to rent my local track on north east was $7400 for event now $11k
