Agreed, I think they screwed you. I would place a call to Ducati NA and see what they have to say about it if indeed paperwork says '13 but vin says '12.

The auto industry routinely introduces the next year model in the previous year (i.g. "New 2014 models" available/offered for sale in the fall of 2013 and obviously manufactured in 2013).

Without knowing specifics of the deal in question, a vehicle offered as a 2013 model having been manufactured in 2012 is not prima facie evidence of fraud or misrepresentation.
 
guys it could be a 13 and use the non oil view fairings. when my fairing melted i specifically asked for the 13 fairing they sent the 12 as a replacement. the reason? i assume because they still had them. i called ducati na and got the oil viewer. that doesnt make my bike a 13 now because i have the 13 fairing? no its still a 12. just as if you get a 13 and you dont have the viewer its still a 13. if your bike was produced in july the seventh month of the year it would be considered a 13. thats the way it is. they can technically label it here in the US a 13 because its after the second half of the year. i have seen and heard both with my own eyes and ears. if state farm has the vin as a 13 its a 13 even though you didnt get the viewer.

better classified as buyer beware.

forget manufacturing date, if the dealer told him it was a 13 but it actualy is a 12 (not manufacture date, but VIN serial) then it is fraud here in the US! I am not up on my UK legal reading but that is pretty cut and dry!

Agreed... But it would appear that the VIN contradicts the Model year claim...(C not D) If so then this throws into question the validity/point of VINS...
 
It's funny listening to all this splitting of the verbiage to arrive at what is fair or not. If the bike was misrepresented to make the sale, truly misrepresented, then social media is really all you need to convey that IMO and let the public be the judge. Bypass the legal mumbo jumbo and get to the truth. If in fact the bike was built in the model year 13 and sold with a 12 vin, then there is a disparity between vin and model year conveyed to the buyer. If the buyer cares about the vin and did not let that be known to the dealer, then it would be the buyers fault for not letting dealer know he wants a 13 coded vin. If he voiced that to the dealer and the dealer still sold him the 12 vin through tricks then that is the dealers bad business behavior. It may be better to identify the dealer's intent rather than accusing just because an inconsistency is found. As far as the viewing hole, well if you told the dealer that you expect all the trimmings of a 13 including viewing hole, then you have a case, otherwise, you really had no idea about the viewing hole and that would be live and learn situation and next time to know exactly what you want before you buy. the hp4 are sold out so you dont have to worry about this shady stuff from bmw. they dont have 2013 hp4 laying around claiming they are 2014 as the bike is worth getting.

I would say it's the dealer and not Bm!

Years ago, my driverside door, power window stopped working.
According to Bm, it needed a new motor.

Had it replaced, and the day after, washing the car, my rear driverside window was .......

shady? Yes. BMW. No.

That's the really interesting question! The Swedish Transportation Authorities does not care about the VIN at all.

Ducati Italy confirmed in writing that my bike is a 2013 even though the tenth digit is a C.

Now I'm waiting for the response from the dealer. That will be interesting :)
